Chapter 1: Setting the Context – an Overview of New Zealand and English Mental Capacity Law

Chapter 1 is in three sections:

  1. Setting the context and understanding the legal concept of capacity.

  2. An overview of mental capacity law in New Zealand, with a particular focus on the jurisdiction under the Protection of Personal and Property Rights Act 1988.

  3. An overview of the historical origins of the Mental Capacity Act (England and Wales) 2005, the law reform that produced it, and the jurisdiction it creates.
